The present study presents a systematic analysis of expert evaluations and forensic psychological reports concerning the child’s competence to testify, with a specific focus on the assessment of general abilities; this in order to investigate such a construct in the most comprehensive and integrated manner possible. In particular, both qualitative and quantitative analyses were conducted: the former addressed the extent to which experts adhered to methodological guidelines during the forensic evaluation, as well as the types of tests most frequently administered – neuropsychological, psychodiagnostic, and projective measures; the latter examined the potential predictive value of the variable "professional role of the evaluator" – e.g., defense-appointed expert, court-appointed expert, or prosecutor’s/CP (= prosecution) expert – with respect to the final forensic opinion. The first and second chapters of this thesis outline, respectively, the concept of testimony within the Italian legal system and within the psycho-forensic context, and the assessment of the child witness, with a focus on the inherent challenges of forensic psychopathology as well as those characterizing the evaluative process itself, together with selected instruments available to the examiner. The third chapter illustrates the research project through the presentation of the research questions and aims of the study, the materials employed, the data extraction procedure, and the data analysis. Finally, the fourth chapter presents the results obtained and their discussion.
Il presente studio consiste in un’analisi sistematica di perizie e consulenze tecniche in tema di idoneità del minore a rendere testimonianza, con specifico approfondimento sulla valutazione delle capacità generiche; ciò al fine di indagare nel modo più completo ed integrato possibile tale fattore. In particolare, sono state condotte delle analisi qualitative e quantitative: le prime sull’aderenza alle linee guida metodologiche da parte dei periti nello svolgimento delle indagini peritali e sulla tipologia di test maggiormente somministrata – neuropsicologici, psicodiagnostici, proiettivi; le seconde sul potenziale valore predittivo della variabile “ruolo professionale del valutatore” – es. valutatore della difesa, esperto del giudice, valutatore del Pubblico Ministero/CP (= prosecution, accusa) – rispetto al responso peritale. Il primo e secondo capitolo del presente elaborato delineano, rispettivamente, il concetto di testimonianza nel sistema processuale italiano e nel contesto psico-forense e la valutazione del minore testimone con attenzione alle criticità intrinseche alla disciplina della psicopatologia forense, nonché caratterizzanti il medesimo processo valutativo e alcuni strumenti utili all’esaminatore. Il terzo capitolo esplica il progetto di ricerca svolto attraverso l’esposizione di domande di ricerca e obiettivi dello studio, materiali utilizzati, procedura di estrazione dati, analisi dei dati. Infine, il quarto capitolo illustra i risultati ottenuti e la discussione di questi ultimi.
