This thesis examines how the national Environmental Impact Assessment legislation of Italy, Germany, Austria and Spain incorporates, or fails to incorporate, a disability-inclusive perspective. Through qualitative content analysis of the current legal frameworks, the study evaluates the visibility of disability, the treatment of justice and rights, and the conditions that shape accessibility and participation of persons with disabilities. The findings reveal a complete absence of references to persons with disabilities and the lack of mechanisms that would guarantee accessible procedures or inclusive participation. Where social aspects appear, they remain limited to broad categories such as the population or human health, reinforcing longstanding critiques in Social Impact Assessment regarding the marginalisation of social diversity in European assessment practice. In response to these gaps, the thesis develops the Inclusive Environmental Impact Assessment Guideline, which translates core principles of Social Impact Assessment, extended and deepened through Disability Justice, into practical guidance for each phase of the Environmental Impact Assessment process. This approach demonstrates how accessibility, participation and social vulnerability can be systematically incorporated into the process. The study concludes that disability inclusion is essential for evaluating the ethical, democratic and social quality of environmental governance and contributes to advancing the integration of Social Impact Assessment within European Environmental Impact Assessment systems.
Esta tesis examina cómo las legislaciones nacionales de Evaluación de Impacto Ambiental de Italia, Alemania, Austria y España incorporan, o no, una perspectiva inclusiva de la discapacidad. A través de un análisis cualitativo de contenido de los marcos legales vigentes, el estudio evalúa la visibilidad de la discapacidad, el tratamiento de la justicia y los derechos, y las condiciones que configuran la accesibilidad y la participación. Los resultados muestran una ausencia total de referencias a las personas con discapacidad y la falta de mecanismos que garanticen procedimientos accesibles o participación inclusiva. Cuando aparecen aspectos sociales, permanecen limitados a categorías amplias como “la población” o “la salud humana”, lo que refuerza las críticas tradicionales de la Social Impact Assessment sobre la marginalización de la diversidad social en la práctica europea. Como respuesta a estas carencias, la tesis desarrolla la Guía de Evaluación de Impacto Ambiental Inclusiva, que traduce los principios fundamentales de la Social Impact Assessment, ampliados y profundizados mediante la Justicia de la Discapacidad, en orientaciones operativas para cada fase del proceso evaluador. Este enfoque muestra cómo la accesibilidad, la participación y la vulnerabilidad social pueden integrarse de manera sistemática. La tesis concluye que la inclusión de la discapacidad es esencial para evaluar la calidad ética, democrática y social de la gobernanza ambiental.
