This thesis analyzes the impact of the integration of artificial intelligence and the infrastructures based on data in the military apparatus, interpreting it not as a simple technological innovation, but as a structural transformation of the modalities of the exercise of power. The emergence of algorithmic warfare marks the passage from a model based on the material force to a model based on the collection, integration, and analysis of data, in which the algorithm takes on a central role in the construction of the military decision. In this context, the data are configured as decisive infrastructures, able to influence the action and affect the distribution of responsibility, that must be rethought along the entire production pipeline of algorithmic systems, starting from the selection of datasets. The increasing integration between military apparatus and private actors in the construction of these infrastructures raises fundamental questions regarding transparency, democratic control, and sovereignty. The thesis examines these transformations in light of constitutional law and European and U.S. legal frameworks, highlighting the implications for citizens' fundamental rights and the position of military personnel. The goal is to show how artificial intelligence operates as a power infrastructure, contributing to redefine the condition of exercise of public decision, and the legal categories through which it is regulated and controlled.
Questa tesi esplora l'impatto dell'intelligenza artificiale e delle infrastrutture basate sui dati nei sistemi militari, vedendola non solo come una nuova tecnologia, ma come un vero cambiamento nel modo in cui il potere pubblico viene esercitato. Con l'avvento della "guerra algoritmica", si passa da un approccio basato sulla forza fisica a uno centrato sulla raccolta, l'integrazione e l'analisi dei dati, dove gli algoritmi giocano un ruolo chiave nel prendere decisioni militari. In questo scenario, i dati diventano vere e proprie infrastrutture cruciali: guidano le azioni e influenzano chi è responsabile di cosa, richiedendo una riflessione profonda su tutta la catena di produzione di questi sistemi, a partire dalla scelta dei dati iniziali. L'alleanza sempre più stretta tra forze armate e aziende private pone poi domande essenziali su trasparenza, controllo democratico e sovranità nazionale. Il lavoro analizza questi mutamenti alla luce del diritto costituzionale e delle normative europee e americane, mettendo in evidenza cosa significhi per i diritti base dei cittadini e per il ruolo dei soldati. In fondo, l'intelligenza artificiale agisce come una sorta di "dorsale" del potere, ridefinendo come prendiamo decisioni pubbliche e le categorie legali che le governano.
