This thesis examines the decision-making process of the criminal judge through an interdisciplinary approach that integrates law and psychology. After analyzing the role of the judge, the substantive principles, and judicial discretion in sentencing, the research explores the influence of cognitive biases, particularly the pro-prosecution bias and the accusatory mindset (Berryessa et al., 2023). Building on this framework, an experimental study is developed, inspired by Engel and Glöckner (2013), aimed at assessing the impact of these biases on the evaluation of evidence, the determination of guilt, and sentencing decisions, as well as the effectiveness of a debiasing intervention (bench card).
La presente tesi analizza il processo decisionale del giudice penale attraverso un approccio interdisciplinare che integra diritto e psicologia. Dopo aver esaminato il ruolo del giudice, i principi sostanziali e la discrezionalità nella commisurazione della pena, la ricerca approfondisce l’influenza dei bias cognitivi, in particolare il pro-prosecution bias e l’accusatory mindset (Berryessa et al., 2023). Su tali basi, viene sviluppato uno studio sperimentale, ispirato a Engel e Glöckner (2013), volto a verificare l’impatto di tali bias sulla valutazione delle prove, sul giudizio di colpevolezza e sulla determinazione della pena, nonché l’efficacia di un intervento di debiasing (bench card)
