In this thesis work, I intend to analyze in a first part the concept of punishment and its evolution in the different conceptions and subsequently, in a second part, I deal with the theme of the restorative justice paradigm, the principles on which it is based on, the fundamental characteristics that differentiate it from the traditional penal system, its origins and the main tools through which it is expressed. Another aspect on which the paper focuses is criminal mediation, the tools and methods of application of this, as they represent one of the most important operational tools for the implementation of restorative justice. After a first theoretical survey, the third and fourth chapters are dedicated to a comparison between the Italian and Belgian contexts on the restorative theme. They explore, also thanks to the support of the experiences of two mediators - one Italian and one Belgian - the regulatory space, the gray areas and the strengths of these experiences. The conclusion is given by some personal reflections on the two different contexts.
In questo lavoro di tesi, intendo analizzare in una prima parte, il concetto di pena e la sua evoluzione nelle diverse concezioni e successivamente, in una seconda parte, affronto il tema del paradigma riparativo, i principi su cui esso si fonda, le caratteristiche fondamentali che lo differenziano dal sistema penale tradizionale, le origini e i principali strumenti attraverso i quali si esplica. Un ulteriore aspetto su cui l’elaborato si sofferma, è la mediazione penale, gli strumenti e le modalità applicative di questa, in quanto rappresentano uno dei più importanti strumenti operativi per l'attuazione della giustizia riparativa. Dopo una prima ricognizione teorica, il terzo e il quarto capitolo sono dedicati ad un confronto tra il contesto italiano e quello belga sul tema riparativo. In essi si esplora, anche grazie al supporto delle esperienze di due mediatori - uno italiano e uno belga - lo spazio normativo, le zone d’ombra e i punti di forza di tali esperienze. La conclusione è data da alcune riflessioni personali in merito ai due diversi contesti.
