Fenomeno migratorio e reati culturalmente motivati: verso un modello riparativamente orientato della gestione del conflitto normo-culturale

The thesis elaborated on the one hand describes the evolution of the migratory phenomenon through a historical excursus, underlining how today societies are increasingly multicultural, as people and culturally different groups coexist, on the other hand it deepens a type of crime, the crime culturally motivated, which can be generated due to a normo-cultural conflict between the cultural and legal norms of the country where the crime occurred and the country of the offender. The final objective of the paper is to propose and illustrate the possibilities and limits of a restorative meditative approach, typical of restorative justice, which can be used to repair the normo-cultural conflict that has arisen, highlighting the role of the community. , of the processes of integration and inclusion of migrants, respecting and protecting the rights of the victim.

La tesi elaborata da un lato descrive l’evoluzione del fenomeno migratorio tramite un excursus storico, sottolineando come ad oggi le società siano sempre più multiculturali, in quanto convivono persone e gruppi culturalmente diversi, dall’altro approfondisce una fattispecie di reato, il reato culturalmente motivato, che si può generare a causa di un conflitto normo-culturale tra le norme culturali e giuridiche del Paese in cui è avvenuto il fatto e il Paese dell’autore del reato. L’obiettivo finale dell'elaborato è quello di proporre e illustrare possibilità e limiti di un approccio meditativo riparativo, proprio della giustizia riparativa, che possa essere utilizzato per riparare al conflitto normo-culturale che si è generato, mettano in risalto il ruolo della comunità, dei processi d’integrazione e d’inclusione delle persone migranti, nel rispetto e nella tutela dei diritti della vittima.
