This thesis is intended to provide an adequate framework of the current legal regime of Islamic buildings of worship in Italy, in order to highlight the evolution of jurisprudence with respect to the necessary balance of interests between the right to religious freedom, protected in a broad sense in the Italian Constitutional Charter, European Law and International and Ecclesiastical Law, and the right to public security, in particular, following the terrorist attacks that followed in Europe, since the resurgence of religious fanaticism of jihadist matrix, after the attack on the Twin Towers of 11 September 2001. It will also be a brief digression on the history of the regulation of Islamic buildings of worship in Italy, and the relationship of the Islamic religious community with Italian regulations, focusing mainly on urban aspects, administrative and religious that involve the construction, conservation and management of places of worship.
Con la presente tesi si intende fornire un quadro adeguato dell'attuale regime giuridico degli edifici di culto islamici in Italia, allo scopo di evidenziare l'evoluzione della giurisprudenza rispetto al necessario bilanciamento di interessi tra il diritto di libertà religiosa, tutelato in senso ampio nella Carta Costituzionale Italiana, nel Diritto Europeo e nel Diritto Internazionale ed Ecclesiastico, e il diritto alla pubblica sicurezza, in particolare, in seguito agli attacchi terroristici seguiti in Europa, a partire dalla recrudescenza del fanatismo religioso di matrice jihadista, dopo l'attacco alle Torri Gemelle dell'11 settembre 2001. Si tratterà inoltre una breve digressione sulla storia della normativa degli edifici di culto islamici in Italia, e del rapporto della comunità religiosa islamica con le normative italiane, focalizzandosi soprattutto sugli aspetti urbanistici, amministrativi e religiosi che coinvolgono l'edificazione, la conservazione e la gestione dei luoghi di culto.
