The theme of the thesis concerns palliative care understood as care and assistance ('cure and care'), aimed at controlling the patient's physical-psychic suffering and social support, with the aim of improving their quality of life and respecting their dignity. With regard to the international situation, the document approved in 2014 by the OMS is analysed, a document that commits all states to develop palliative care and indicates it as a fundamental human right. In the same year, the OMS also published, together with the Worldwide Palliative Care Alliance (WPCA), the Global atlas of palliative care at the end of life. As far as the Italian national situation is concerned, the legislation regulating palliative care and pain therapy is law n. 38/2010 "Provisions to ensure access to palliative care and pain therapy" The paper is framed within the overall ethical debate on the end of life, the palliative care seen not as an alternative but as accompaniment of the terminally ill patient.
Il tema trattato dalla tesi riguarda le Cure palliative intese come cura e assistenza (“cure and care”), finalizzate al controllo della sofferenza fisica-psichica e al supporto sociale del paziente, nell’intento di migliorarne la qualità di vita e nel rispetto della sua dignità. Per quanto concerne la situazione internazionale viene analizzato il documento approvato nel 2014 dall'OMS, un documento che impegna tutti gli Stati a sviluppare le cure palliative e le indica come un diritto umano fondamentale. Nello stesso anno l'OMS ha anche pubblicato, congiuntamente alla Worldwide Palliative Care Alliance (WPCA), il Global atlas of palliative care at the end of life. Mentre per quel che riguarda la situazione nazionale italiana, la normativa che regola le cure palliative e la terapia del dolore è la legge n. 38/2010 “Disposizioni per garantire l'accesso alle cure palliative e alla terapia del dolore”. L'elaborato è inquadrato nell’ambito del dibattito etico complessivo sul fine-vita ovvero le cure palliative viste non come alternativa ma come accompagnamento del malato in fase terminale.
