La salute della persona sottoposta a regime di detenzione tra diritti e doveri.

The aim of this paper is to provide a representative picture of how the right to health is guaranteed within the context of deprivation of liberty. This seems of great interest, given the peculiarities of the prison environment in which apparently irreconcilable needs intersect and considering that every year, in Italian prisons, more than 100 thousand people transit, to whom the right to health must be constitutionally guaranteed. In recent months a controversial case of news, starring the anarchist insurrectionist militant Alfredo Cospito, who started a hunger strike to protest against the 41-bis regime to which he has been subjected since May 2022, animated the public debate about the compatibility of art. 13, 27 and 32 of the Constitution with the condition of physical fragility of the subject and about the legitimacy of laws or acts of secondary standardization that, influencing essential choices of the individual - such as that of feeding or not, to be treated or not - could undermine fundamental human rights. In this regard, we must ask ourselves how the protection of health and the self-determination of the individual relate to the more strictly security profiles as the health area and the custodial area both affect the same subject, in a constant intersection whose boundaries do not seem easy to trace.

L'obiettivo di questo elaborato è fornire un quadro rappresentativo di come il diritto alla salute venga garantito all'interno di contesti privativi della libertà. Ciò appare di profondo interesse, date le peculiarità dell'ambiente carcerario nel quale si intersecano esigenze apparentemente inconciliabili e considerando che ogni anno, nelle carceri italiane, transitano oltre 100 mila persone, alle quali deve essere costituzionalmente garantito il diritto alla salute. Negli ultimi mesi un controverso caso di cronaca, avente come protagonista il militante anarchico insurrezionalista Alfredo Cospito, il quale ha avviato uno sciopero della fame per protestare contro il regime del 41-bis a cui è stato sottoposto da maggio 2022, ha animato il dibattito pubblico circa la compatibilità degli artt. 13, 27 e 32 della Costituzione con la condizione di fragilità fisica del soggetto e circa la legittimità di leggi o atti di normazione secondaria che, influendo su scelte essenziali dell’individuo – come quella di alimentarsi o no, di essere curati o no – potrebbero pregiudicare diritti fondamentali della persona. Sotto questo aspetto, occorre domandarsi come la tutela della salute e l’autodeterminazione dell’individuo si rapportino con i profili più strettamente securitari in quanto l'area sanitaria e l'area custodiale incidono entrambe sul medesimo soggetto, in una costante intersezione di cui non appare semplice tracciare i confini.
