The study investigates Italian immigration policies and laws to analyse their penalising effects on migrants and asylum-seekers in Italy. Following an analysis of Article 31 of the Geneva Convention relating to the Status of Refugees on the principle of non-penalisation, the text goes on to analyse the phenomenon of 'crimmigration,' the convergence between criminal law and migration law that has become increasingly common in recent decades. Taking these premises into consideration, an evaluation of the Italian immigration framework and policies is conducted, incorporating insights from various organisations and civil society. The analysis of Italy is set in a European context and, through a comparison with Great Britain and Greece, potential common policies are observed to comprehend their criminalising scope.
La ricerca si occupa di analizzare le pratiche e le norme italiane in tema di immigrazione, nel tentativo di comprendere se queste penalizzino i migranti e i richiedenti asilo in Italia. Dopo aver analizzato l’articolo 31 della Convenzione di Ginevra sullo Status dei Rifugiati sul principio di non-penalizzazione, il testo passa in analisi il fenomeno della “crimmigration”, ossia la convergenza tra il diritto penale e il diritto migratorio, sempre più frequente negli ultimi decenni. Con queste premesse, viene svolta un’analisi del framework e delle politiche italiane di immigrazione, anche attraverso le osservazioni di organizzazioni e società civile. L’analisi italiana viene inserita nel quadro europeo e, svolgendo una comparazione con la Gran Bretagna e la Grecia, si osservano le eventuali politiche comuni per comprenderne la portata criminalizzante.
