The vagueness of some regulations in the public contracts code and in the Third sector code, has generated fears and question marks over the years. The lack of coordination between the two, has been the origin of interpretative difficulties that have caused much controversy. Their interaction is delicate, especially concerning the uneasy balance between the principle of competition and the principles of solidarity and subsidiarity. Nevertheless, jurisprudential guidelines have been stabilizing, beginning to offer more certainty.
La genericità di alcune norme contenute nel codice dei contratti pubblici e nel codice del Terzo settore ha creato timori e punti interrogativi nel corso degli anni. Il mancato coordinamento tra i due è stato all’origine di difficoltà interpretative che hanno causato molte controversie. La loro interazione è delicata, soprattutto per quanto concerne il non facile contemperamento tra il principio di concorrenza ed i principi di solidarietà e di sussidiarietà. Ciò nonostante, gli orientamenti giurisprudenziali si sono andati a stabilizzare, cominciando ad offrire maggiori certezze.
