Translation and law: Analysis and translation of a judgment from English into Italian

Legal translation is a very complex specialised skill. The aim of this thesis is to analyse the legal translation process by comparing two different legal systems, the Italian civil law model and the English common law model. Furthermore, it presents the problems and challenges that legal translators are faced with. This dissertation is divided into three chapters. In the first part, the theoretical background of legal translation is presented with an emphasis on the different choices the legal translator is called upon to make in producing the target text. In the analysis of the translation process, I focus on the figure and role of the translator as the central character in this subject, as he is called upon to perform a demanding task and has to solve many difficulties. Then, by offering a practical example, I want to demonstrate the choices and strategies adopted in such a complex translation process. My translation was conceived with the aim of being read by hypothetical legal experts such as lawyers or judges. Finally, the last pages present an analysis and commentary on the translation process.

La traduzione legale è una competenza specializzata molto complessa. Lo scopo di questa tesi è quello di analizzare il processo di traduzione giuridica mettendo a confronto due diversi sistemi giuridici, quello italiano della civil law e quello inglese della common law. Inoltre, presenta i problemi e le sfide che i traduttori legali sono chiamati ad affrontare. Questa dissertazione è divisa in tre capitoli. Nella prima parte, è presentato il background teorico della traduzione legale con un’enfasi sulle diverse scelte che il traduttore legale è chiamato a fare nella produzione del testo d'arrivo. Nell'analisi del processo traduttivo mi soffermo sulla figura e sul ruolo del traduttore come elemento centrale di tale materia, in quanto chiamato a svolgere un compito impegnativo e si trova a dover risolvere molte difficoltà. Successivamente, offrendone un esempio pratico voglio dimostrare le scelte e le strategie adottate in un processo traduttivo così complesso. La mia traduzione è stata sviluppata con lo scopo di essere letta da ipotetici esperti di diritto come avvocati o giudici. Infine, le ultime pagine presentano l'analisi e un commento sul processo traduttivo.
