Consumer habits have changed radically with the spread of credit agreements. This has made it necessary to have detailed regulations that regulate consumer relations and protect the consumer figurer, the weaker contractual party and often placed in a disadvantaged position, due to the lack of information that prevails in the financial area. With a view to consumer protection and in order to avoid his over-indebtedness, this thesis analyzes the legislator’s provisions in this area, focusing on Testo Unico Bancario, which identifies in particular the contractual characteristics of the case in question and the information obligations to be paid by the lender. Then, the thesis examines in detail the fundamental role assumed by credi scoring and its assessment, functional to the granting of credit, deepening the issues relating to the obligation to verify credit scoring ex art. 124 bis T.U.B. and the liability that may arise on the part of the lender who has granted the credit for a not sustainable amount by the debtor. To prevent such situations, controls, legal constraints and prudential rules are a constant in the activities of financial operators, but this study argues that, in order to avoid consumer over-indebtedness, financial information and education play a fundamental role, helping to make the request for credit aware and adequate to one's possibilities.
Le abitudini dei consumatori sono cambiate radicalmente con la diffusione dei contratti di credito. Ciò ha reso necessaria una disciplina dettagliata che regolasse i rapporti di consumo e tutelasse la figura del consumatore, parte debole del contratto e spesso posto in una posizione svantaggiata, a causa della carenza informativa che domina nel settore finanziario. In un’ottica di tutela del consumatore e al fine di evitare il sovraindebitamento dello stesso, questa tesi analizza quanto previsto in tale ambito dal legislatore, soffermandosi sul Testo Unico Bancario, il quale individua in particolar modo le caratteristiche contrattuali della fattispecie in esame e gli obblighi informativi a carico del finanziatore. Procedendo si esamina nel dettaglio il ruolo fondamentale assunto dal merito creditizio e dalla sua valutazione, funzionale alla concessione del credito, approfondendo le questioni relative all’obbligo di verifica del credit scoring ex art.124 bis del T.U.B. e alla responsabilità che può sorgere in capo al finanziatore che abbia concesso il credito per un importo non sostenibile dal debitore. Per prevenire simili situazioni, controlli, vincoli giuridici e regole prudenziali sono una costante nelle attività degli operatori finanziari, ma tale studio sostiene che, al fine di evitare il sovraindebitamento del consumatore, l’informazione e l’educazione finanziaria giochino un ruolo fondamentale, contribuendo a rendere la richiesta di credito consapevole ed adeguata alle proprie possibilità.
