This research focuses on the possibilities of recognizing refugee status for Brazilian trans women in Italian territory. The relevance of the work is justified by the absence of extensive data and academic works on this topic, on this social group and the need to give them visibility. The main objective is to demonstrate that Brazilian trans women have the right to refugee status in Italy since they belong to a discriminated social group, suffer human rights violations and have their lives and physical integrity at serious risk in their own country. To do this, this research will give an explanation of what refugee and persecution are; an explanation of what the LGBTIQ+ refuge is and what the legislative panorama is in Italy; and a demonstration through little data and academic research of the constituent elements of the persecution of trans women in Brazil: social exclusion, the difficulty in accessing fundamental rights such as healthcare, school and work, the high number of murders and suicides. In conclusion, the social situation of trans women in Brazil explains their well-founded fear of persecution.
La presente ricerca si concentra sulle possibilità di riconoscimento dello status di rifugiato alle donne trans brasiliane nel territorio italiano. La rilevanza del lavoro è giustificata dall'assenza di ampi dati e lavori accademici su questo argomento, su questo gruppo sociale e sulla necessità di dar loro visibilità. L'obiettivo principale è dimostrare che le donne trans brasiliane hanno diritto allo status di rifugiato in Italia poiché appartengono a un gruppo sociale discriminato, subiscono violazioni dei diritti umani e hanno la loro vita e integrità fisica a grave rischio nel proprio Paese. Per fare ciò, questa ricerca darà una spiegazione su cosa siano la persona rifugiata e la persecuzione; una spiegazione su cosa è il rifugio LGBTIQ+ e quale è il panorama legislativo in Italia; e una dimostrazione attraverso pochi dati e ricerche accademiche degli elementi costitutivi della persecuzione delle donne trans in Brasile: l'esclusione sociale, la difficoltà di accedere ai diritti fondamentali come l'assistenza sanitaria, la scuola e il lavoro, l'elevato numero di omicidi e suicidi. In conclusione, la situazione sociale delle donne trans in Brasile spiega il loro fondato timore di persecuzione.
