L'istituto della sospensione del processo con messa alla prova del minore autore di reato. Il caso studio dell'U.S.S.M. di Trieste.

The experimental thesis aims to investigate, through a follow-up, the effect of probation on children who have committed a crime between the ages of 14 and 18 and whether it has been effective over time. The thesis is divided into two parts. A first theoretical part that delves into juvenile deviance, its possible causes and its prevention, with reference to the most recent and main studies on the topic. The theoretical part also aims to outline a legal/regulatory framework to frame the topic of testing with minors. The second part is characterized by the analysis of the data from the interviews carried out with the children and the presentation of the results of the research. The research question arises from the need to verify the MAP expressed by the Prosecutor's Office of the Court of Trieste and the USSM. The research focuses on understanding the effectiveness of testing, its educational function, but above all on its impact on the personal growth of children.

La tesi sperimentale si pone l'obiettivo di approfondire, tramite un follow up, l'effetto della messa alla prova nei ragazzi che hanno compiuto un reato dai 14 ai 18 anni di età e se la stessa ha avuto efficacia nel tempo. La tesi si divide in due parti. Una prima parte teorica che approfondisce la devianza minorile, le sue possibili cause e la sua prevenzione, con riferimento ai più recenti e principali studi sul tema. La parte teorica si pone, inoltre, l'obiettivo di delineare una cornice giuridico/normativa per inquadrare il tema della messa alla prova con i minori. La seconda parte è caratterizzata dall'analisi dei dati delle interviste fatte ai ragazzi e dall'esposizione degli esiti della ricerca. La domanda di ricerca nasce dall’esigenza di verifica della MAP manifestata dalla Procura del Tribunale di Trieste e dall’USSM. La ricerca verte sulla comprensione dell'efficacia della messa alla prova, della sua funzione educativa, ma soprattutto sulla sua incidenza nella crescita personale dei ragazzi.
