Sheria Lacunae: Addressing Gaps in Human Rights Law in East and Horn of Africa

The East and Horn of Africa region has long been subject to the scrutiny of human rights institutions. Though diverse due to the several countries that comprise the region, the East and Horn of Africa has a common history and a common fate. The human rights violations present in the region have been a result of the weak institutions that are present in the nations concerned. The thesis explores the historical background of the East and Horn of Africa starting from the 20th century and wants to offer an analysis of the legislative framework of human rights law, starting from the development of the universal characteristic of it, elaborating on the core human rights treaties, and continuing with the study of the system of regional protection of human rights in the continent, namely the African Charter on Human and Peoples’ Rights. After offering an examination of these protection mechanisms, the dissertation will elaborate on the human rights violations present in the countries concerned through reports, cases, and institutional documents that thoroughly describe the main areas of concern inherent to the upholding of human rights. Finally, this thesis wants to promote an optimistic view of the future of the region, in line with Pan-African values, the basic principles promoted by human rights law, and the promising vision of the African Union regarding the fate of the continent as a whole.

La regione dell'Est e del Corno d'Africa è da tempo oggetto di attenzione da parte delle istituzioni per i diritti umani. Pur essendo diversa a causa dei numerosi Paesi che la compongono, la regione dell'Est e del Corno d'Africa ha una storia e un destino comune. Le violazioni dei diritti umani presenti nella regione sono il risultato della debolezza delle istituzioni presenti nelle nazioni interessate. La tesi esplora il contesto storico dell'Africa orientale e del Corno d'Africa a partire dal XX secolo e vuole offrire un'analisi del quadro legislativo del diritto dei diritti umani, partendo dallo sviluppo della sua caratteristica universale, elaborando i trattati fondamentali sui diritti umani, e proseguendo con lo studio del sistema di protezione regionale dei diritti umani nel continente, ovvero la Carta africana dei diritti umani e dei popoli. Dopo aver offerto un esame di questi meccanismi di protezione, la tesi elaborerà le violazioni dei diritti umani presenti nei Paesi interessati attraverso rapporti, casi e documenti istituzionali che descrivono in modo approfondito le principali aree di preoccupazione inerenti al rispetto dei diritti umani. Infine, questa tesi vuole promuovere una visione ottimistica del futuro della regione, in linea con i valori panafricani, i principi fondamentali promossi dalla legge sui diritti umani e la promettente visione dell'Unione Africana riguardo al destino del continente nel suo complesso.
