L'EVOLUZIONE NORMATIVA DEL DIRITTO DI ACCESSO AGLI ATTI DELLA PUBBLICA AMMINISTRAZIONE E LA TUTELA DELLA RISERVATEZZA

The paper intends to retrace the regulatory evolution of the right of access to public administration documents, examining the current legislation that provides for the coexistence of different types of access, also defining their limits and exclusions. The relationship between the right of access and the right to privacy will be analyzed, rights equally recognized by the legal system, which are often in conflict with each other and therefore require an adequate balance, sometimes difficult.

L’elaborato intende ripercorrere l’evoluzione normativa del diritto di accesso agli atti della pubblica amministrazione, approfondendo l’attuale disciplina che prevede la coesistenza di diverse tipologie di accesso, definendone altresì limiti ed esclusioni. Verrà analizzato il rapporto tra il diritto di accesso e il diritto alla riservatezza, diritti ugualmente riconosciuti dall’ordinamento, che spesso si trovano in contrasto tra loro e che pertanto richiedono un adeguato bilanciamento, talvolta difficoltoso.
