The subject of this paper is the labour discipline concerning victims of duty. The aim of the project is to provide a regulatory and jurisprudential framework regarding the discipline about this category. For this purpose, the current legislation on victims of duty and the associated case law will be described. The benefits available to victims will be identified, along with the process of equating victims of duty with victims of terrorism and organized crime. Furthermore, the procedure for recognizing the status of a victim of duty will be explained, including the assessment of injuries and the criteria used by the Medical Hospital Commissions to quantify the damage sustained by the victims. Finally, the competent court for disputes related to the recognition of the status and the allocation of benefits will be clarified, specifically the ordinary court, acting as the labor court.
L'oggetto del presente elaborato è la disciplina lavoristica sulle vittime del dovere. Lo scopo del progetto è fornire un quadro normativo e giurisprudenziale circa la disciplina regolante tale categoria. Con questa finalità, verrà descritta la normativa vigente in materia di vittime del dovere e la giurisprudenza annessa. Saranno poi individuati i benefici spettanti alle vittime e il processo di equiparazione tra vittime del dovere e vittime del terrorismo e della criminalità organizzata. Verrà inoltre illustrato l'iter procedurale per il riconoscimento dello status di vittima del dovere, la valutazione delle lesioni e i criteri utilizzati dalle Commissioni Mediche Ospedaliere per percentualizzare il danno riportato dalle vittime. Infine, verrà chiarito quale sia il giudice competente nelle controversie relative al riconoscimento dello status e all'attribuzione dei benefici, ovvero il giudice ordinario, in funzione del giudice del lavoro.
