This thesis explores the landscape as both a legal and cultural category, starting from Article 9 of the Italian Constitution, with particular focus on the case of the Graticolato Romano in the Veneto region. A product of Roman centuriation dating back to the 2nd century BCE, the Graticolato is still clearly visible in the plains of Padua and Venice, standing out as a historical landscape of exceptional identity value. The research examines the multi-level regulatory framework governing landscape protection: from the constitutional provisions to national legislation (Legislative Decree 42/2004), regional policies (Veneto Regional Law no. 11/2004), and local instruments, including Landscape Plans and Landscape Observatories. Particular attention is given to the role of the European Landscape Convention and to the co-planning mechanisms between State and Regions. Through a legal-territorial analysis and the examination of administrative practices, institutional documents, and civic initiatives, the study highlights how the Graticolato is currently threatened by land consumption, urban sprawl, and unsustainable infrastructural development. Nonetheless, it also represents an opportunity: an open-air laboratory for integrated governance practices, landscape education, and sustainable cultural tourism.
Questa tesi esplora il paesaggio come categoria giuridica e culturale, a partire dall’articolo 9 della Costituzione italiana, con particolare riferimento al caso del Graticolato Romano nel Veneto. Frutto della centuriazione romana realizzata a partire dal II secolo a.C., il Graticolato è ancora oggi leggibile nella pianura padovana e veneziana, configurandosi come un paesaggio storico di straordinaria rilevanza identitaria. La ricerca analizza il quadro normativo multilivello che disciplina la tutela del paesaggio: dal dettato costituzionale agli strumenti legislativi nazionali (D.lgs. 42/2004), dalle politiche regionali (Legge Regionale Veneto n. 11/2004) ai dispositivi locali, inclusi i Piani Paesaggistici e gli Osservatori del Paesaggio. Viene dedicato ampio spazio al ruolo della Convenzione Europea del Paesaggio e alla co-pianificazione tra Stato e Regioni. Attraverso un’analisi giuridico-territoriale e l’esame di pratiche amministrative, documenti istituzionali e iniziative civiche, si mette in luce come il Graticolato sia oggi minacciato da fenomeni come consumo di suolo, urbanizzazione diffusa e infrastrutturazione non sostenibile. Tuttavia, esso rappresenta anche un’opportunità: un laboratorio a cielo aperto per pratiche di governance integrata, educazione al paesaggio e turismo culturale sostenibile.
