The current assessment system, governed by D.Lgs. 66/2010 and D.P.R. 90/2010, is based on technical directives and the ministerial tables listing “imperfections and infirmities that are causes of unfitness for military service.” However, the technical discretion granted to the Medical Boards (Commissioni Mediche Ospedaliere, CMO) often leads to interpretative and evaluative inconsistencies among similar cases, resulting in potential inequities and administrative disputes. The aim of this study is to propose a standardization of the evaluation process through the development of a shared medico-legal methodology that integrates scientific, legal, and functional criteria. The proposed method seeks to harmonize the assessment of unconditional and institutional military fitness, allowing for a more objective evaluation of infirmities in relation to their functional compatibility with the operational duties of the Carabinieri. This proposal stems from the analysis of the activity of the First Medical Board of the Department of Legal Medicine of Padua and the discussion of representative clinical cases. The goal is to outline an evaluation pathway based on measurable medico-legal parameters, taking into account the unique nature of the Carabinieri, who must maintain full physical and mental efficiency in every operational circumstance. In conclusion, the standardization of the medico-legal evaluation process does not aim to limit clinical discretion but rather to align it within a transparent and reproducible methodological framework, thereby strengthening both the protection of the service member’s health and the overall operational effectiveness of the Carabinieri Corps.
L’idoneità al servizio nell’Arma dei Carabinieri rappresenta un presupposto essenziale per garantire l’efficienza operativa, la sicurezza individuale e collettiva e la continuità funzionale dell’Istituzione. L’attuale sistema di valutazione, disciplinato dal D.Lgs. 66/2010 e dal D.P.R. 90/2010, si fonda su direttive tecniche e sull’applicazione delle tabelle ministeriali delle “imperfezioni e infermità che sono causa di non idoneità al servizio militare”. Tuttavia, la discrezionalità tecnica attribuita alle Commissioni Mediche Ospedaliere (CMO) determina talvolta difformità interpretative e valutative tra casi analoghi, con conseguente rischio di iniquità e contenzioso amministrativo. Lo scopo di questo studio è proporre una standardizzazione del processo valutativo attraverso l’elaborazione di un metodo medico-legale condiviso, capace di integrare criteri scientifici, giuridici e funzionali. Il metodo proposto mira a uniformare l’accertamento dell’idoneità al servizio militare incondizionato e d’istituto, consentendo una valutazione più oggettiva delle infermità in rapporto alla compatibilità funzionale con le mansioni proprie dell’Arma dei Carabinieri. La proposta nasce dall’analisi dell’attività della I Commissione Medica Ospedaliera del Dipartimento di Medicina Legale di Padova e dall’elaborazione di casi clinici rappresentativi. L’obiettivo è delineare un percorso valutativo fondato su parametri medico-legali misurabili, che tenga conto della specificità del ruolo del Carabiniere, chiamato a mantenere piena efficienza fisica e psichica in ogni circostanza operativa. In conclusione, la standardizzazione della valutazione medico-legale non si propone di ridurre la discrezionalità clinica, ma di armonizzarla all’interno di un quadro metodologico trasparente e riproducibile, rafforzando la tutela della salute del militare e l’efficienza complessiva dell’Arma.
