This thesis explores the Italian and European regulatory framework on Green Public Procurement (GPP), conceived as both a public policy tool and a strategic instrument for the ecological transition. GPP aims to steer the market by integrating environmental criteria into public procurement procedures. After reconstructing the evolution of the European legal framework and its transposition into the national system, the study focuses on the environmental provisions set out in the Public Contracts Code of 2016 (Legislative Decree No. 50/2016) and in the new Code of 2023 (Legislative Decree No. 36/2023). The research highlights the main innovations and the potential impacts of the new regulations on sustainability through a comparative analysis with the previous framework. Finally, it discusses the main obstacles and future challenges in implementing GPP in Italy and suggests ways to achieve a more comprehensive integration of environmental criteria into public procurement practices.
Questa tesi esamina il quadro normativo italiano ed europeo in materia di Green Public Procurement (GPP), in quanto strumento di politica pubblica e leva strategica della transizione ecologica, volto a orientare il mercato mediante l'introduzione di criteri ambientali nelle procedure di evidenza pubblica. Dopo aver ricostruito l'evoluzione del contesto normativo europeo e il suo recepimento nell'ordinamento interno, il lavoro si concentra sull'analisi delle disposizioni ambientali contenute nel Codice dei contratti pubblici del 2016 (D.lgs. n. 50/2016) e nel successivo Codice del 2023 (D.lgs. n. 36/2023). La ricerca evidenzia le principali innovazioni e i potenziali effetti delle nuove disposizioni sotto il profilo della sostenibilità attraverso un'analisi comparativa con il quadro previgente. Infine, si delineano le criticità e le future sfide applicative del GPP in Italia, formulando altresì proposte per favorire una più compiuta integrazione delle esigenze di sostenibilità ambientale nelle procedure di gara.
