L'indennizzo atteso per la servitù di passaggio nei vigneti: un'indagine presso gli agricoltori

The easement of passage is part of the easements which are defined by the Civil Code as a "weight imposed on a fund for the benefit of another fund belonging to a different owner" (art.1027 Civil Code). The aim of this thesis is to quantify the economic value of a hypothetical easement of passage proposed individually, plot by plot, to a group of 102 vine-growers and to verify whether the willingness to accept an indemnity is in line with or diverges from what the law provides for. The main peculiarities found in this survey are: 1. Based on the size of the hypothetical easement, winegrowers requested an average compensation of 35,42 €/m2, slightly diverging from the compensation provided by law, i.e. 34 €/m2. 2. Statistically, with reference to rows, there aren’t highly significant differences between the elimination of a row, no row or parts of a row. 3. The Garganega variety requires a higher compensation than other varieties such as Prosecco and Chardonnay.

La servitù di passaggio fa parte delle servitù prediali che vengono definite dal Codice civile come un “peso imposto sopra un fondo per l’utilità di un altro fondo appartenente a diverso proprietario” (art.1027 c.c.). Questa tesi ha lo scopo di quantificare il valore economico di una ipotetica servitù di passaggio proposta singolarmente, appezzamento per appezzamento, ad un gruppo di 102 viticoltori e verificare se la disponibilità all’accettazione di un indennizzo è in linea o diverge in base a quello che prevede la legge. Le principali peculiarità rinvenute in questa indagine sono: 1. In base alle dimensioni dell’ipotetica servitù i viticoltori hanno richiesto un indennizzo medio di 35,42 €/m2, leggermente divergente rispetto all’indennizzo previsto per legge, ovvero 34 €/m2. 2. Statisticamente, in riferimento ai filari non ci sono differenze altamente significative tra eliminazione di un filare, nessun filare o alcune parti di filare. 3. La varietà Garganega richiede un indennizzo superiore rispetto alle altre varietà come Prosecco e Chardonnay.
