This paper addresses the issue of the protection of vulnerable victims in Italian criminal proceedings, with particular attention to the evidentiary hearing procedure pursuant to Article 392(1-bis) of the Italian Code of Criminal Procedure. The analysis begins with the examination of the concept of “vulnerable victim” in the light of European directives and domestic legislation, with specific reference to protection from the risk of secondary victimisation. Then, the role of evidentiary hearings in the trial system si explored, as a privileged means of examining the testimony of victims in particularly vulnerable situations. In conclusion, the study examines the case law guidelines on the rejection of requests for evidentiary hearing concerning the testimony of victims of offences included in the list referred to in Article 392, paragraph 1-bis of the Code of Criminal Procedure, with particular regard to the ruling of the Supreme Court No. 10869 of March 2025, which qualified the rejection of such a request as abnormal.
Il presente elaborato affronta il tema della tutela della vittima vulnerabile nel processo penale italiano, con particolare attenzione allo strumento dell’incidente probatorio ex art. 392 comma 1-bis c.p.p. L’analisi prende avvio dall’esame del concetto di “vittima vulnerabile” alla luce delle direttive europee e della normativa interna, con specifico riferimento alla protezione dal rischio di vittimizzazione secondaria. Successivamente, si approfondisce il ruolo dell’incidente probatorio nel sistema processuale, quale mezzo privilegiato per l’escussione della prova dichiarativa delle persone offese in condizione di particolare vulnerabilità. Infine, vengono esaminati gli orientamenti giurisprudenziali in materia di rigetto della richiesta di incidente probatorio avente ad oggetto la testimonianza della persona offesa di uno dei reati compresi nell’elenco di cui all’art. 392, comma 1-bis c.p.p, con particolare riguardo alla pronuncia delle Sezioni Unite n. 10869 di marzo 2025, che ha qualificato come abnorme il provvedimento di rigetto di tale istanza.
