This thesis reconstructs the evolution of the principle of self-organization in Italian public administration, starting from the first forms of cooperation between entities up to the innovations of the 2023 public contract reform. At the beginning, the origins of administrative collaboration are covered, showing how the various forms of cooperation between administrations already existed well before their codification in Art. 15 of Law 241/1990. It then continues with the turning point represented by Art. 7 of the new Contracts Code (Legislative Decree 36/2023), which introduces a real principle of "administrative self-organization" as an alternative to market logic. It ends with the link between self-organization and digitalization, taking as an example in-house companies operating in the IT sector.
Questa tesi ricostruisce l'evoluzione del principio di auto-organizzazione nella pubblica amministrazione italiana, partendo dalle prime forme di cooperazione tra enti fino ad arrivare alle innovazioni della riforma dei contratti pubblici del 2023. All’inizio vengono trattate le origini della collaborazione amministrativa, mostrando come le varie forme di cooperazione tra amministrazioni esistessero già ben prima della loro codificazione nell'art. 15 della legge 241/1990. Si prosegue poi con la svolta rappresentata dall'art. 7 del nuovo Codice dei contratti (D.Lgs. 36/2023), che introduce un vero e proprio principio di "auto-organizzazione amministrativa" come alternativa alla logica di mercato. Si conclude con il legame tra auto-organizzazione e digitalizzazione, prendendo come esempio le società in house che operano nel settore informatico.
