The thesis examines the legal framework of the irregular pledge and its application in banking law through the Lombard Loan product. After reconstructing the regulatory and case law profiles, the research focuses on the legal nature of the Lombard Loan and its risk factors. A specific section is devoted to the economic and financial function of this instrument, while the final part addresses its practical implications for banking advisory and private banking, highlighting opportunities and responsibilities of the financial advisor.
La tesi analizza la disciplina del pegno irregolare e la sua applicazione nel diritto bancario attraverso il prodotto del Credito Lombard. Dopo aver ricostruito i profili normativi e giurisprudenziali, l’elaborato si concentra sull’inquadramento giuridico del Lombard Loan e sui suoi profili di rischio. Una parte è dedicata alla funzione economico-finanziaria di tale strumento, mentre la sezione finale affronta le implicazioni pratiche per la consulenza bancaria e il private banking, evidenziando opportunità e responsabilità del consulente.
