La piattaforma ODR per i consumatori dell' Unione Europea. Analisi di un insuccesso.

This paper explores the vast and intricate landscape of ODR (Online Dispute Resolution), the most recent evolution of the well-established ADR (Alternative Dispute Resolution) mechanisms. The core of the research provides a detailed and critical analysis of the ODR platform developed by the European Union. This platform was designed as a free tool for consumers and businesses to resolve online cross-border disputes regarding goods or services through an out-of-court, cost-effective, and rapid process. The primary objective of this paper is to evaluate the potential, the shortcomings, the functioning, and the structural framework of this platform, which permanently ceased its operations on July 20, 2026.

Questa tesi tratterà della vasta e intricata realtà delle ODR (acronimo che sta per Online Dispute Resolution) le quali sono le "figlie" più recenti delle giá conosciute ADR (Alternative Dispute Resolution); per poi passare alla trattazione, più attenta e critica della piattaforma ODR creata dall'Unione Europea. La medesima piattaforma è fruibile liberamente dai consumatori e dalle imprese per risolvere controversie inerenti ad acquisti e scambi in rete, di beni o servizi, in modo extragiudiziale, economico e veloce. L elaborato si pone come obiettivo primario quello di valutare le potenzialità, le criticità, il funzionamento e la struttura di questa piattaforma; quest' ultima ha cessato definitivamente la sua attività il 20 Luglio del 2026
