This paper analyzes the concept of self-defense, focusing on its origins and recent regulatory reforms, with particular attention to the “Stacchio case,” which took place in February 2015 in Ponte di Nanto. The thesis also explores the issue of health and safety at work, including in relation to incidents of assault and robbery. The aim of the research is to understand the evolution of self-defense and its application to specific cases, as well as to carry out a comparative law analysis with other legal systems, including the United States, France, and Germany, assessing how the Stacchio case would have been judged in those contexts. The study is based mainly on criminal and labor law manuals and was enriched by a personal meeting with Graziano Stacchio, which allowed the case to be analyzed from a direct perspective. The results provide an understanding of the application of the principles of self-defense and the differences between the various legal systems.
Il presente elaborato analizza l’istituto della legittima difesa, soffermandosi sulle sue origini e sulle recenti riforme normative, con particolare attenzione al “Caso Stacchio”, avvenuto nel febbraio 2015 a Ponte di Nanto. La tesi approfondisce inoltre il tema della salute e della sicurezza sul lavoro, anche in relazione a episodi di aggressioni e rapine. L’obiettivo della ricerca è comprendere l’evoluzione della legittima difesa e la sua applicazione a casi concreti, nonché effettuare un’analisi di diritto comparato con altri ordinamenti, tra cui Stati Uniti, Francia e Germania, valutando come il Caso Stacchio sarebbe stato giudicato in tali contesti. Lo studio si basa principalmente su manuali di diritto penale e del lavoro ed è stato arricchito da un incontro personale con Graziano Stacchio, che ha permesso di analizzare il caso anche da una prospettiva diretta. I risultati consentono di comprendere l’applicazione dei principi della legittima difesa e le differenze tra i diversi sistemi giuridici.
