La tutela del lavoratore nel trasferimento di azienda

The paper aims to analyse the specific case of business transfers between European legislation and domestic law with the aim of providing, first of all, a general overview of the notional aspect with regard to the business, the branch of the company and the related transfers. Subsequently, the analysis focuses on describing the protection of the transferred worker, such as the continuation of the employment relationship with its implications and the preservation of the rights that pre-existed the transfer. Finally, as a final aspect, the paper focuses on the procedure envisaged for the transfer of a healthy company and then focuses on what is regulated with regard to the transfer of a company in crisis.

L’elaborato mira ad analizzare la fattispecie del trasferimento d’azienda tra la legislazione europea e il diritto interno con l’obiettivo di dare, in primo luogo, una visione generale sull’aspetto nozionistico per quanto riguarda l’azienda, il ramo d’azienda e i relativi trasferimenti. Successivamente, l’analisi si focalizza sulla descrizione della tutela del lavoratore trasferito quale la prosecuzione del rapporto di lavoro con le relative implicazioni e la conservazione dei diritti che preesistevano alla cessione. Infine, come ultimo aspetto, l’elaborato si sofferma sulla procedura prevista per il trasferimento di un’azienda sana e in seguito si concentra su quanto disciplinato con riguardo al trasferimento di un’azienda in crisi.
