The paper proposes a systematic analysis of the right of Defence and the institution of the modification of the imputation, examined from a multilevel perspective. In the first part of the discussion, the right of Defence is deepened as a fundamental principle of the legal system, starting from its constitutional foundation referred to in art. 24 Const. The investigation then focusses on the analysis of supranational sources, through the examination of the protection guaranteed by the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union, as well as the broader framework of the international protection of fundamental rights. In the second part of the paper, we proceed to analyse the modification of the accusation, moving from the notion of accusation and its role in the criminal process, and then investigate the ways in which it can change during the proceedings, with particular attention to the different procedural phases. In this context, the main positions of national doctrine and jurisprudence regarding the relationship between modification of the imputation and the right of Defence are deepened. Finally, an in-depth investigation is carried out, the starting point of which is offered by the judgement of the Court of Justice of the European Union, C-175/22, BK, regarding the keeping of defensive guarantees in the internal legal system in the face of changes in the accusation.
L’elaborato propone un’analisi sistematica del diritto di difesa e dell’istituto della modifica dell’imputazione, esaminati in una prospettiva multilivello. In una prima parte della trattazione viene approfondito il diritto di difesa quale principio fondamentale dell’ordinamento, a partire dal suo fondamento costituzionale di cui all’art. 24 Cost. L’indagine si concentra poi sull’analisi delle fonti sovranazionali, attraverso l’esame della tutela garantita dalla Convenzione europea dei diritti dell’uomo e dalla Carta dei diritti fondamentali dell’Unione europea, nonché al più ampio quadro della protezione internazionale dei diritti fondamentali. Nella seconda parte dell’ elaborato si procede all’analisi della modifica dell’imputazione, muovendo dalla nozione di accusa e dal suo ruolo nel processo penale, per poi indagare le modalità con cui essa può mutare nel corso del procedimento, con particolare attenzione alle diverse fasi processuali. In tale contesto vengono approfondite le principali posizioni della dottrina e della giurisprudenza nazionali in ordine al rapporto tra modifica dell’imputazione e diritto di difesa. Da ultimo, si procede ad un approfondimento, il cui spunto è offerto dalla sentenza della Corte di giustizia dell’Unione europea, C-175/22, BK, in ordine alla tenuta delle garanzie difensive nell’ordinamento interno a fronte delle modifiche dell’accusa.
