This thesis examines the system of alternative sanctions to imprisonment, focusing on their regulatory evolution and on the increasingly central role they play within the Italian penal system. In particular, the work analyses the content and legal framework of alternative sanctions both before and after the Cartabia reform, highlighting the main innovations introduced and the differences compared to the previous regulatory system. The aim of the research is to demonstrate how these measures constitute a concrete and functional alternative to custodial sentences, capable of addressing the structural shortcomings of the prison system, foremost among them prison overcrowding. The analysis also shows how alternative sanctions are more consistent with the constitutional principle of the rehabilitative purpose of punishment, offering offenders paths of accountability and social reintegration that are more effective than incarceration. Finally, the thesis seeks to emphasize the role of alternative sanctions not only as tools to reduce reliance on imprisonment but also as means to prevent recidivism and to promote the reintegration of individuals into society.
La tesi analizza il sistema delle pene sostitutive alla detenzione, soffermandosi sulla loro evoluzione normativa e sul ruolo sempre più centrale che esse assumono nel panorama sanzionatorio italiano. In particolare, l’elaborato esamina il contenuto e la disciplina delle pene sostitutive prima e dopo la riforma Cartabia, mettendo in luce le principali novità introdotte e le differenze rispetto al previgente assetto normativo. L’obiettivo è quello di dimostrare come tali strumenti rappresentino un’alternativa concreta e funzionale alla pena detentiva, idonea a rispondere alle criticità strutturali del sistema carcerario, primo fra tutti il fenomeno del sovraffollamento. L’analisi evidenzia, inoltre, come le pene sostitutive siano maggiormente coerenti con il principio costituzionale della funzione rieducativa della pena, offrendo al condannato percorsi di responsabilizzazione e reinserimento sociale più efficaci rispetto alla detenzione intramuraria. La tesi si propone, infine, di valorizzare il ruolo delle pene sostitutive come strumenti capaci non solo di deflazionare il ricorso al carcere ma anche di contribuire alla prevenzione della recidiva e alla formazione di individui reintegrati nella società.
