The paper aims to examine the innovations introduced by the new European Union Pact on Migration and Asylum, with particular focus on the border procedure. To this end, after a concise reconstruction of the regulatory framework established by the instruments composing the Pact, the analysis turns to the three main stages of the border procedure: screening, examination of the asylum application, and return. For each of these stages, the study highlights the potential risks to the protection of fundamental rights and the corresponding solutions proposed by legal doctrine. Finally, the analysis provides an overall assessment of the critical issues identified, evaluating — from a critical perspective — the actual effectiveness of the proposed solutions in ensuring compliance with fundamental rights.
L’elaborato si propone di analizzare le innovazioni introdotte dal nuovo Patto dell’Unione europea su migrazione e asilo, con particolare attenzione alla procedura di frontiera. A tal fine, dopo una sintetica ricostruzione della disciplina delineata dai regolamenti che compongono il Patto, vengono esaminate le tre fasi principali della procedura di frontiera: screening, esame della domanda di asilo e rimpatrio. Per ciascuna di esse si mettono in luce i potenziali rischi per la tutela dei diritti fondamentali e le relative soluzioni prospettate dalla dottrina. Infine, l’analisi offre una visione complessiva delle criticità emerse, valutando in chiave critica l’effettiva idoneità delle soluzioni prospettate a garantire il rispetto dei diritti fondamentali.
