IL RESPONSABILE DEL SERVIZIO DI PREVENZIONE E PROTEZIONE: la sua responsabilità e il suo ruolo nella Sicurezza sul lavoro

This paper aims to explore in depth the role and responsibility of the Responsible of the Prevention and Protection Service (RSPP), focusing on their function as a manager of Health and Safety in the workplace, as well as their advisory role in drafting the Risk Assessment Document (DVR). The Responsible of the Prevention and Protection Service bears a different type of responsibility compared to other individuals involved in workplace safety, yet their role remains crucial in defining prevention strategies and organizing the company’s overall safety system. Therefore, various cases involving the RSPP and their actual responsibility within those situations will be analyzed. The paper also seeks to clarify the interpersonal relationship between the Responsible of the Prevention and Protection Service and the Employer, who holds non-delegable obligations regarding workplace safety, as well as with the Workers’ Safety Representative, who represents employees on matters related to health and safety at work. Thus, the paper addresses the different aspects of the RSPP’s role and the limits of their responsibility within the workplace safety system. This is an area that significantly influences the world of work and remains a topic of ongoing debate within companies, despite the importance of its proper management and the interaction between the various stakeholders involved in the prevention system.

L’elaborato propone di approfondire il ruolo e la responsabilità del Responsabile del Servizio di Prevenzione e Protezione (RSPP) con riferimento alla sua funzione di gestore della Salute e Sicurezza nei luoghi di lavoro e con la conseguente funzione di consulenza nella redazione del Documento di Valutazione dei Rischi (DVR). L’RSPP possiede una responsabilità differente in confronto agli altri soggetti che intervengono nella Sicurezza sul lavoro, ovvero non è titolare di una funzione di garanzia ma solo di una funzione consultiva, ma la sua attività assume comunque una rilevanza importante nella definizione delle strategie di prevenzione e nel sistema di organizzazione della sicurezza all’interno dell’azienda. Per cui verranno analizzati vari casi in cui è stata coinvolta la figura del RSPP e la sua effettiva responsabilità all’interno degli stessi. Il lavoro mira a chiarire altresì la relazione interpersonale dell’RSPP con la figura del DDL, ovvero il soggetto titolare degli obblighi in materia di sicurezza sul lavoro che sono indelegabili e del RLS, soggetto che si occupa di rappresentare i lavoratori in materia di salute e sicurezza sui luoghi di lavoro. L’elaborato dunque tratta i vari aspetti del RSPP e i limiti della sua responsabilità all’interno della sicurezza sul lavoro, la quale influenza il mondo del lavoro in maniera significativa ma che rappresenta una questione ancora oggi dibattuta all’interno delle aziende, riconoscendo comunque l’importanza di una corretta gestione di essa e dell’interazione tra i diversi attori nel sistema di prevenzione.
