Recenti novità legislative in tema di associazioni e società sportive dilettantistiche

This paper analyses the complex regulatory framework that regulates amateur sports associations and clubs, paying particular attention to the legislative impacts produced by the recent reforms of the Third Sector (Legislative Decree no. 117/2017) and sport (Legislative Decree no. 36/2021). Starting from the legal definition of sporting activity and its regulatory evolution, we will then analyze the division of jurisdiction between the State and the Regions. We will then examine the subjects of the sporting system (CONI, FSN, DSA, EPS) and forms of sporting organization (ESD. ASD, SSD), and the distinction between commercial activity. This will not lead us to the Third Sector Code and the critical reasons and aspects of the reform. The second chapter analyzes the enabling law, the social enterprise regulations, the National Single Register of the Third Sector, and the qualifying choice for ASD and SSD members. Finally, the third one will complete the analysis by specifically addressing sports reform.

Il presente elaborato analizza il complesso quadro normativo che regola le associazioni e società sportive dilettantistiche ponendo particolare attenzione agli impatti legislativi prodotti dalla recenti riforme del Terzo settore (D.Lgs. n. 117/2017) e dello sport (D.Lgs. n. 36/2021). Partendo dalla definizione giuridica di attività sportiva e della sua evoluzione normativa analizzeremo poi il riparto di competente tra Stato e Regioni. un'esamina poi dei soggetti dell'ordinamento sportivo (CONI, FSN, DSA, EPS) e delle forme di organizzazione sportiva (ESD. ASD, SSD) e della distinzione tra attività commerciale e non ci condurrà verso il codice del terzo settore e delle ragioni e profili critici della riforma. Nel secondo capitolo vengono analizzate la legge delega, la disciplina dell'impresa sociale, il Registro Unico Nazionale del Terzo Settore e la scelta qualificante per le ASD e SSD di iscriversi. Infine il terzo completerà l'analisi trattando nello specifico la riforma dello sport.
