Brevetti e modernità industriale: un'analisi storico-giuridica tra Stati Uniti e Regno Unito nel XIX secolo

The thesis analyzes the evolution of patent systems in the nineteenth century, comparing the British and United States models in order to understand their impact on industrial modernity. Through a historical-legal and comparative approach, the study reconstructs the transformation of the patent from a sovereign privilege into a subjective right of the inventor. In the United Kingdom, an elitist and selective system emerges, characterized by complex and costly procedures, whereas in the United States a more accessible and democratic model takes shape, especially after the 1836 reform. The research highlights how these differences contributed to shaping distinct paths of industrial development and different forms of capitalism. Finally, the comparison underscores the importance of balancing the protection of inventions with the dissemination of technical knowledge.

La tesi analizza l’evoluzione dei sistemi brevettuali nel XIX secolo, mettendo a confronto il modello britannico e quello statunitense per comprenderne l’impatto sulla modernità industriale. Attraverso un approccio storico-giuridico e comparato, il lavoro ricostruisce il passaggio del brevetto da privilegio sovrano a diritto soggettivo dell’inventore. Nel Regno Unito emerge un sistema elitario e selettivo, caratterizzato da procedure complesse e costose, mentre negli Stati Uniti si afferma un modello più accessibile e democratico, soprattutto dopo la riforma del 1836. La ricerca evidenzia come tali differenze abbiano contribuito a plasmare percorsi distinti di sviluppo industriale e forme diverse di capitalismo. Il confronto mostra infine l’importanza del bilanciamento tra tutela dell’invenzione e diffusione della conoscenza tecnica.
