This paper’s objective is to investigate the respect for fundamental rights and the implications they are subjected to by the usage of intelligent systems and related technologies, with a particular focus on real-time remote biometric identification systems. The paper first provides a brief description of the European regulatory framework, examining recent legislation, the methods by which these technologies are regulated, and their correlation with human rights. Secondly, the regulatory model of the People's Republic of China begins, introduced by a brief description of the relevant national laws, then are presented the dynamics of interaction between the State, corporations, and citizens, the numerous implications for human rights, and finally a detailed description of the surveillance technologies and systems widely utilized within the Republic.
Obbiettivo del seguente elaborato è indagare il rispetto dei diritti fondamentali, e le implicazioni alle quali i medesimi sono soggetti nell’utilizzo di sistemi intelligenti e ulteriori tecnologie ad essi affini, in particolare dei sistemi a rilevazione biometrica a distanza in tempo reale. Viene presentata quindi un’iniziale descrizione del modello normativo europeo, le recenti normative in materia, le modalità con cui essi regolano tali tecnologie e la loro correlazione coi diritti umani. Successivamente viene poi presentato il modello normativo della Repubblica Popolare Cinese, introdotto da una breve descrizione delle normative rilevanti in materia, per poi seguire con le modalità di interazione tra Stato, imprese e cittadini, le varie implicazioni sorte nel rispetto dei diritti umani, e infine una dettagliata descrizione delle tecnologie e sistemi di sorveglianza utilizzati all’interno della suddetta Repubblica Popolare.
