This thesis examines the relationship between freedom of expression and online content moderation, with particular reference to the European regulatory framework and constitutional law perspectives. The analysis is based on the recognition of freedom of expression as a fundamental right and focuses on the transformations this right undergoes in the digital environment, which is significantly shaped by online platforms. The thesis further analyzes the various content moderation practices and algorithmic censorship, examining their functioning and related legal implications. In this context, the study explores the use of artificial intelligence systems in the selection and control of online content, focusing on the limitations arising from the lack of critical capacity and on potential algorithmic biases that may affect the exercise of freedom of expression. For illustrative purposes, the thesis refers to selected cases and concrete content moderation practices in order to clarify the legal issues connected with the interaction between algorithms, digital platforms, and freedom of expression.
La presente tesi esamina il rapporto tra libertà di espressione e moderazione dei contenuti online, con particolare riferimento al quadro normativo europeo e ai profili di diritto costituzionale. L’analisi muove dal riconoscimento della libertà di manifestazione del pensiero come diritto fondamentale e si concentra sulle trasformazioni che tale diritto subisce nel contesto digitale, caratterizzato in modo significativo dal ruolo delle piattaforme online. Vengono analizzate le principali pratiche di moderazione dei contenuti e la censura algoritmica, soffermandosi sul loro funzionamento e sulle relative implicazioni giuridiche. In tale ambito, la tesi approfondisce l’utilizzo di sistemi di intelligenza artificiale nella selezione e nel controllo dei contenuti, evidenziando i limiti derivanti dall’assenza di capacità critica e i possibili bias che possono incidere sull’esercizio della libertà di espressione. A fini esemplificativi, l’elaborato richiama alcuni casi e pratiche concrete di moderazione dei contenuti, allo scopo di chiarire le problematiche giuridiche connesse all’interazione tra algoritmi.
