The thesis analyzes the evolution of dismissal regulations in Italy, with particular attention to the regime governing “below-threshold” enterprises. After retracing the historical origins and the main legislative reforms from 1966 to 2018, the study focuses on the special system applicable to microenterprises and its critical issues. Consideration is given to recent developments, ranging from the CGIL referendum of 2025 to Constitutional Court ruling no. 118/2025. The conclusions reflect on the need to rebalance protections between workers and enterprises of different sizes.
La tesi analizza l’evoluzione della disciplina dei licenziamenti in Italia, con particolare attenzione al regime delle imprese “sotto soglia”. Dopo aver ripercorso le origini storiche e le principali riforme legislative dal 1966 al 2018, lo studio si concentra sul sistema speciale applicabile alle microimprese e sulle sue criticità. Viene dato spazio agli sviluppi recenti, dal referendum CGIL del 2025 alla sentenza n. 118/2025 della Corte costituzionale. Le conclusioni riflettono sulla necessità di un riequilibrio delle tutele tra lavoratori e imprese di diversa dimensione.
