This thesis examines workplace safety through the interaction between legislation and case law, focusing on health protection as a fundamental right under Article 32 of the Italian Constitution. Particular attention is given to Legislative Decree no. 81/2008 and Legislative Decree no. 231/2001, which extend liability to the organizational dimension of enterprises. The study aims to analyze the criteria for attributing criminal liability, with regard to positions of guarantee, delegation of functions, and corporate liability. The analysis shows a shift from individual conduct to the adequacy of organizational structures and risk management. The findings highlight a prevention-oriented model in which compliance tools play a key role in ensuring effective protection.
La tesi analizza il sistema della sicurezza sul lavoro attraverso il rapporto tra normativa e giurisprudenza, alla luce della tutela della salute quale diritto fondamentale ex art. 32 Cost. Particolare attenzione è dedicata al d.lgs. n. 81/2008 e al d.lgs. n. 231/2001, che hanno esteso la responsabilità alla dimensione organizzativa dell’impresa. L’obiettivo è esaminare i criteri di imputazione della responsabilità penale, con riferimento alle posizioni di garanzia, alla delega di funzioni e alla responsabilità degli enti. L’analisi evidenzia come il sistema prevenzionistico abbia progressivamente spostato il focus dalla condotta individuale all’adeguatezza dell’organizzazione aziendale e alla gestione del rischio. Ne emerge un modello orientato alla prevenzione, in cui gli strumenti di compliance assumono un ruolo centrale per l’effettività della tutela.
