La sicurezza nei luoghi di lavoro: il caso ThyssenKrupp

This thesis analyses the health and safety system in the workplace, in the light of Legislative Decree 81/2008 n81. After a reconstruction of the constitutional and regulatory framework of reference, the paper deepens the role of the main subjects of the prevention system. Ample space is reserved for risk management as the fulcrum of the system outlined by the single text, understood as a process of identification, evaluation and reduction of the dangers present in the work environment. The analysis shows that safety at work is not only a legal obligation, but also an organisational and social value oriented to the protection of the psychophysical integrity of the worker and the continuous improvement of working conditions. Finally, the analysis of the ThyssenKrupp case will follow, which concerns a serious fire that occurred at the ThyssenKrupp plant in Turin, in which seven workers lost their lives.

La presente tesi analizza il sistema della salute e sicurezza nei luoghi di lavoro, alla luce del decreto legislativo 81/2008 n81. Dopo una ricostruzione del quadro costituzionale e normativo di riferimento, l’elaborato approfondisce il ruolo dei principali soggetti del sistema di prevenzione. Ampio spazio è riservato alla gestione del rischio quale fulcro del sistema delineato dal testo unico, inteso come processo di individuazione, valutazione e riduzione dei pericoli presenti nell’ambiente di lavoro. L’analisi evidenza come la sicurezza sul lavoro costituisca non solo un obbligo giuridico, ma anche un valore organizzativo e sociale orientato alla tutela dell’integrità psicofisica del lavoratore e al miglioramento continuo delle condizioni di lavoro. Infine seguirà l’analisi del caso ThyssenKrupp, che riguarda un grave incendio verificatosi presso lo stabilimento ThyssenKrupp di Torino, nel quale persero la vita sette operai.
