In recent decades, the development of information and communication technologies (ICT) has brought about a transformation of contemporary society, profoundly affecting many aspects of people’s economic, social, and institutional lives. This transformation has also progressively involved public administrations, leading to changes in how services are delivered and in the relationship between these administrations and the private sector, with the aim of optimizing the efficiency and quality of services offered to citizens. The healthcare sector is one of the areas most affected by the process of computerization. The digitization of the healthcare system is one of the factors aimed at improving the efficiency of the National Health System (NHS): the introduction of the Electronic Health Record (EHR) fits into this context, serving as a tool for collecting data and making information regarding a patient’s medical history accessible in digital format. This paper aims to analyse the topic of the digitization of the Public Administration, with particular regard to the healthcare sector and the role played by the EHR: specifically, it will focus on the evolution of the European and national regulatory framework, as well as on the main legal issues related to the processing of health data and the balance between individual rights and public interests, also in light of the new European Health Data Space (EHDS) Regulation.
Negli ultimi decenni, lo sviluppo delle tecnologie dell’informazione e della comunicazione (TIC) ha determinato un cambiamento della società contemporanea, segnando profondamente molteplici aspetti della vita economica, sociale, istituzionale delle persone. Tale trasformazione ha progressivamente coinvolto anche le Pubbliche Amministrazioni, comportando un’alterazione delle modalità di erogazione dei servizi e del rapporto tra queste ultime e i privati, con lo scopo di ottimizzare l’efficienza e la qualità dei servizi offerti ai cittadini. Il settore sanitario rappresenta uno degli ambiti maggiormente interessati dal processo di informatizzazione. La digitalizzazione del sistema sanitario costituisce uno dei fattori volti al miglioramento dell’efficienza del Sistema Sanitario Nazionale (SSN): in questa prospettiva, si colloca l’introduzione del Fascicolo Sanitario Elettronico (FSE), strumento teso alla raccolta dei dati e a rendere accessibili in formato digitale le informazioni relative alla storia clinica del paziente. Il presente elaborato si propone di analizzare il tema della digitalizzazione della Pubblica Amministrazione, con particolare riguardo al settore sanitario e al ruolo assunto dal FSE: nello specifico, sarà incentrato sull’evoluzione del quadro normativo europeo e nazionale, nonché sulle principali problematiche giuridiche connesse al trattamento dei dati sanitari e il bilanciamento tra diritti individuali e interessi pubblici, anche alla luce del nuovo Regolamento sullo Spazio Europeo dei Dati Sanitari (EHDS).
