Transizioni e Costituzioni: un confronto tra Italia e Spagna

This dissertation provides a comparative analysis of the democratic transition in Italy and Spain, focusing on the relationship between the historical and political development of the two countries and the drafting of their subsequent democratic constitutions. Through a historical examination of the transition from dictatorship to democracy, the thesis highlights both similarities and differences between the Italian and Spanish cases, allowing for an understanding of how the respective modes of transition influenced the structure, principles, and institutional balances of their constitutions. In particular, the thesis explores the relationship between continuity and rupture with the authoritarian past, the decisive role played by political and social forces in the transition toward a new democratic order, and the different approaches adopted in addressing territorial issues and the protection of fundamental rights, highlighting the elements of mutual constitution influence.

Il presente elaborato consegue un'analisi comparata tra le transizioni democratiche di Italia e Spagna, soffermandosi sul rapporto tra il percorso storico-politico dei rispettivi paesi e l'elaborazione delle successive costituzioni democratiche. Mediante l'esame storico del passaggio dalla dittatura alla democrazia, la tesi evidenzia elementi di convergenza e differenza tra il caso italiano e spagnolo che permette di comprendere come le relative modalità di transizione abbiano inciso sulla struttura, principi ed equilibri istituzionali delle costituzioni. In particolare, la tesi approfondisce il rapporto tra continuità e rottura con il passato autoritario, il ruolo determinante delle forze politiche e sociali nel passaggio al nuovo ordine democratico e i diversi approcci usati per definire le questioni territoriali e i diritti fondamentali, evidenziando gli elementi di reciproca influenza costituzionale.
