This thesis analyzes the issue of union rights for workers hired under temporary employment contracts, a situation characterized by the trilateral relationship between user, worker, and provider. After examining the historical and regulatory evolution from the 1997 Treu law to the provisions contained in Legislative Decree 81/2015, the research highlights the importance of the principle of equal treatment and the role of collective bargaining agreements in administration. The main trade union rights provided for by the legal system are explored in depth, namely the right to freedom of association, the right to strike, and the right to form assemblies. In particular, the function of company trade union representatives (RSA/RSU) is emphasized and outlined in order to ensure the proper exercise of trade union rights within the workplace.
Il presente elaborato analizza il tema inerente ai diritti sindacali dei lavoratori assunti con contratto di somministrazione di lavoro, una fattispecie contraddistinta dal rapporto trilaterale costituito da utilizzatore, lavoratore e somministratore. Dopo aver esaminato l’evoluzione storica e normativa a partire dalla legge Treu del 1997 fino alle disposizioni contenute all’interno del D.lgs 81/2015, la ricerca evidenzia l’importanza del principio di parità di trattamento ed il ruolo dei contratti collettivi all’interno della somministrazione. Vengono approfonditi i principali diritti sindacali previsti dall’ordinamento, ossia il diritto di libertà sindacale, il diritto di sciopero ed il diritto di costituire assemblee, in particolare sottolineando e delineando la funzione delle rappresentanze sindacali aziendali (RSA/RSU) al fine di garantire un corretto esercizio dei diritti sindacali all’interno dei luoghi di lavoro.
