This paper analyzes the right to disconnect as a tool for protecting workers' mental and physical health in the current context of digitalized work. The constant use of technology and the spread of smart working have progressively reduced the separation between work and rest time, fostering hyper-connectivity, work-related stress, and burnout. Starting from constitutional principles and the employer's obligation to ensure safety enshrined in Article 2087 of the Italian Civil Code, the paper examines the national regulatory framework, with particular reference to Legislative Decree 81/2008 and Law No. 81/2017, as well as the contribution of case law. A comparison is also made with some European experiences, highlighting the role of disconnection as a preventative measure. In conclusion, the right to disconnect emerges as an essential tool for ensuring a work-life balance and for preserving the dignity and well-being of workers.
Il presente elaborato analizza il diritto alla disconnessione come strumento di tutela della salute psicofisica del lavoratore nell’attuale contesto di digitalizzazione del lavoro. L’uso costante delle tecnologie e la diffusione del lavoro agile hanno progressivamente ridotto la separazione tra tempo di lavoro e tempo di riposo, favorendo fenomeni di iper-connessione, stress lavoro-correlato e burnout. Partendo dai principi costituzionali e dall’obbligo di sicurezza del datore di lavoro sancito dall’art. 2087 c.c., il lavoro esamina il quadro normativo nazionale, con particolare riferimento al D.Lgs. 81/2008 e alla Legge n. 81/2017, nonché il contributo della giurisprudenza. Viene inoltre svolto un confronto con alcune esperienze europee, evidenziando il ruolo della disconnessione come misura preventiva. Il diritto alla disconnessione emerge, in conclusione, come strumento essenziale per garantire l’equilibrio tra vita privata e lavorativa e per preservare la dignità e il benessere del lavoratore.
