This thesis examines the protection of human rights in environmental contexts through a detailed analysis of the case La Oroya v. Peru, decided on by the Inter-American Court of Human Rights. The study opens with an overview of the factual background and traces the procedural trajectory of the case within the Inter-American human rights system. It then provides a critical assessment of the substantive rights at issue and of the Court’s reasoning, with particular emphasis on State obligations and the principle of due diligence. The final section analyzes the violations established by the Court and the corresponding reparations, highlighting the broader significance of the case for the development of international human rights law in environmental matters.
La presente tesi analizza la tutela dei diritti umani in materia ambientale attraverso lo studio del caso La Oroya v. Peru, deciso dalla Corte interamericana dei diritti umani. Dopo una breve ricostruzione del contesto fattuale e del percorso davanti al sistema interamericano, l’elaborato esamina i principali diritti coinvolti e il ragionamento della Corte, con particolare attenzione agli obblighi dello Stato e al principio della due diligence. Infine, vengono considerate le violazioni accertate e le relative riparazioni, evidenziando il rilievo del caso nel rapporto tra tutela dei diritti umani e ambiente.
