This thesis analyses regional intervention in the regulation of end - of - life matters, in light of the rulings of the Italian Constitutional Court and the existing legislative framework. In particular, the research focuses on the role assumed by the Regions in regulating an area characterized by the absence of a comprehensive state- level regulation. The aim is to demonstrate how the Regions have adopted regulatory measures intended to give concrete effect to the principles established by case law. The methodology is based on the analysis of judicial decisions and the examination of the main regional initiatives. The findings reveal an increasing normative fragmentation, with significant implications for the uniformity of rights and the allocation of competences between the State and the Regions.
La presente tesi analizza l’intervento regionale in merito alla disciplina del fine - vita, alla luce degli interventi della giurisprudenza costituzionale italiana e della legislazione vigente. In particolare, la ricerca si concentra sul ruolo assunto dalle Regioni nel disciplinare una materia caratterizzata dall’assenza di una regolazione statale organica. L’obiettivo è dimostrare come le Regioni abbiano adottato atti normativi volti a dare viva attuazione ai principi enunciati dalla giurisprudenza. La metodologia si basa sull’analisi della giurisprudenza e sull’esame delle principali iniziative regionali. I risultati dimostrano una crescente frammentazione normativa, con rilevanti implicazioni in termini di uniformità dei diritti e riparto di competenze tra Stato e Regioni
