Women's education represents a crucial challenge of the contemporary global context. The right to education should be a fundamental right that belongs to all human beings, regardless of gender. In many countries, it is a right effectively guaranteed and recognized to all individuals; in other contexts, however, access to education is not fully equitable, and women still face numerous obstacles, turning a universal right into a limited or subordinate possibility. Pakistan represents one of the cases where the topic of women's education takes on a contradictory and complex character. On the one hand Pakistan, having ratified the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), has registered many advances in the area of women's education. On the other hand, the country has difficulties in integrating women into the education system. This paper aims to analyze the topic of women's education in Pakistan, highlighting the improvements achieved through the ratification of CEDAW but also the limitations present in the country. This analysis is accompanied by a legal exploration of the Convention and the right to education in the Pakistani context, with the aim of answering the following research question: “To what extent has Article 10 of CEDAW contributed to ensuring effective equal access to girls' education in Pakistan?”
L’educazione femminile rappresenta una sfida cruciale del contesto globale contemporaneo. Il diritto all’istruzione dovrebbe costituire un diritto fondamentale che spetta a tutti gli esseri umani, indipendentemente dal genere. In molti paesi è un diritto effettivamente garantito e riconosciuto a tutti gli individui; in altri contesti, tuttavia, l’accesso all’istruzione non è pienamente equo e le donne incontrano ancora numerosi ostacoli, trasformando un diritto universale in una possibilità limitata o subordinata. Il Pakistan rappresenta uno dei casi dove il tema dell’educazione femminile assume un carattere contradditorio e complesso. Da un lato il Pakistan, avendo ratificato la Convenzione sull’eliminazione di ogni forma di discriminazione nei confronti delle donne (CEDAW), ha registrato numerosi progressi in ambito di educazione femminile. Dall’altro lato, il paese presenta difficoltà nell’integrazione delle donne nel sistema educativo. Il presente lavoro ha come obbiettivo quello di analizzare il tema dell’educazione femminile in Pakistan, sottolineando i miglioramenti ottenuti tramite la ratificazione della CEDAW ma anche i limiti presenti nel paese. A tale analisi si affianca un approfondimento giuridico della Convenzione e del diritto all’istruzione nel contesto pakistano, con l’obbiettivo di rispondere alla seguente domanda di ricerca: “in che misura l’articolo 10 della CEDAW ha contribuito a garantire l’effettiva parità di accesso all’istruzione femminile in Pakistan?”.
