This thesis analyzes the concept of judicial discretion through a comparison between the theories of H. L. A. Hart and Ronald Dworkin. The paper begins with a detailed description of their respective conceptions of law, and then examines how each author understands legal discretion; it emerges that it is not an isolated element. Through this comparative analysis, differences and points of contact will emerge, which will be developed in the final chapter. There are two ultimate goals: to clarify the nature of judicial discretion in contemporary law and, above all, to show how the contrast between Hart and Dworkin is less radical than has traditionally been assumed.

La presente tesi analizza il concetto di discrezionalità giudiziale attraverso il confronto tra le teorie di H.L.A. Hart e Ronald Dworkin. Il lavoro inizia con la descrizione dettagliata delle rispettive concezioni del diritto, per poi approfondire il modo in cui i due autori concepiscono la discrezionalità giuridica; ne emergerà come essa non sia un elemento isolato. Attraverso questa analisi comparativa, emergeranno differenze e punti di contatto che verranno sviluppati nell’ultimo capitolo. L'obbiettivo finale è duplice: chiarire la natura della discrezionalità giudiziale nel diritto contemporaneo e, soprattutto, mostrare come il contrasto tra Hart e Dworkin sia meno radicale di quanto tradizionalmente sostenuto.
