The thesis aims to analyze the evolution of the concept of reason of state and the role of international law as an attempt to limit its logic. The research is conducted through a historical-theoretical analysis that reconstructs the main transformations of modern and contemporary political thought, from the formation of the modern state to the post-1945 international order. The main objective is to demonstrate that the current crisis of international law is a direct consequence of the persistence of the logic of reason of state as the ultimate criterion of political action. In the absence of a supranational authority endowed with effective coercive power, international law is configured as a system of self-limitation of state sovereignty, vulnerable to suspension or circumvention whenever fundamental political interests are at stake.
L’elaborato si propone di analizzare l’evoluzione del concetto di ragion di Stato e il ruolo del diritto internazionale come tentativo di limitarne la logica. La ricerca è stata condotta attraverso un’analisi storico-teorica che ricostruisce le principali trasformazioni del pensiero politico moderno e contemporaneo, dall’età della formazione dello Stato moderno fino all’ordine internazionale successivo al 1945. L’obiettivo principale è dimostrare che la crisi del diritto internazionale odierno sia la diretta conseguenza della persistenza della logica della ragion di Stato come criterio ultimo dell’agire politico. In assenza di un’autorità sovranazionale dotata di un’effettiva forza coercitiva, il diritto internazionale si configura come un sistema di autolimitazione della sovranità statale, esposto alla possibilità di sospensione o elusione quando entrano in gioco interessi politici fondamentali.
