This work examines the multilevel system for the protection of natural protected areas, analysing the interactions between European Union law, the Italian national legal order and regional legislation. The first chapter reconstructs the evolution of European environmental policy and the founding principles of the Natura 2000 Network, with particular attention to Article 6 of the Habitat Directive 92/43/EEC. The second chapter addresses the transposition of these frameworks into the Italian legal order, from the Framework Law No. 394/1991 to the division of competences between the State and the Regions, through to the regulation of liability for environmental damage under the Environmental Code. The third chapter develops a specific analysis focused on the Parco del Fiume Sile, examining the coordination between the different levels of environmental governance. The analysis highlights how the system, formally coherent in its hierarchical architecture, presents at the implementation level recurring shortcomings attributable to the fragmentation of multilevel governance and to the difficulties of institutional coordination among the various competent authorities.
Il presente lavoro esamina il sistema multilivello di tutela delle aree naturali protette, analizzando le interazioni tra il diritto dell'Unione europea, l'ordinamento nazionale italiano e la disciplina regionale. Il primo capitolo ricostruisce l'evoluzione della politica ambientale europea e i principi cardine della Rete Natura 2000, con particolare attenzione all'art. 6 della Direttiva Habitat 92/43/CEE. Il secondo capitolo affronta la ricezione di tali istanze nell'ordinamento italiano, dalla legge quadro n. 394/1991 al riparto di competenze tra Stato e Regioni, fino alla disciplina della responsabilità per danno ambientale nel Codice dell'ambiente. Il terzo capitolo sviluppa un'analisi specifica incentrata sul Parco del Fiume Sile, esaminando il coordinamento tra i diversi livelli della governance ambientale. L'analisi evidenzia come il sistema, formalmente coerente nella sua architettura gerarchica, presenti sul piano attuativo ricorrenti criticità riconducibili alla frammentazione della governance multilivello e alle difficoltà di coordinamento istituzionale tra i diversi enti competenti.
