I disastri marittimi e le norme: ordinamento internazionale, europeo e italiano

The paper exposes the complex system of International, European and Italian Law relating to maritime disasters that cause sea pollution, in particular, oil pollution. Therefore how to prevent, intervene and how to attribute the resulting responsibilities. On the basis of International Conventions, European Directives and National Regulations, it has essentially emerged that there are strict rules governing large ships such as oil tankers, there are a series of authorities that intervene in such cases and finally, that responsibility is attributed to the owner of the ship but that owing to insurance or other forms of financial guarantees and the International Fund created specifically for this purpose, the person responsible is protected at the same level as the victims. Instead, what it is not enough safeguarded is the marine environment which often takes the second place.

L’elaborato espone il complesso sistema di norme internazionali, europee e italiane relative ai disastri marittimi che provocano l’inquinamento del mare, in particolare, da idrocarburi. Dunque, come prevenire, intervenire e in che modo attribuire le responsabilità che ne derivano. Sulla base delle convenzioni internazionali, direttive comunitarie e disposizioni nazionali è emerso sostanzialmente che vi sono severe norme che regolamentano le navi di grandi dimensioni come le petroliere, vi sono una serie di autorità che intervengono in tali casi e infine, che la responsabilità viene attribuita al proprietario della nave ma che grazie alle assicurazioni o altre forme di garanzie finanziarie e il fondo internazionale creato appositamente, il responsabile è tutelato allo stesso livello delle vittime. Quello che, invece, non è abbastanza salvaguardato è l'ambiente marino che spesso passa in secondo piano.
